Terms and conditions

How buying, delivery, returns and complaints work with me — and how I handle your data.

2. What these terms govern

They govern the sale of goods through this website to natural and legal persons. The relationship with a consumer is governed by Act No 108/2024 Coll. on consumer protection and by the Civil Code; the relationship with a business by the Commercial Code.

By sending an order you confirm that you have read these terms and agree to them.

3. Age 18

I sell goods only to persons over 18 years of age. You confirm this when ordering by ticking a box. If I find that an order was placed by a younger person, I will cancel it.

4. Ordering and formation of the contract

You place goods in the cart, fill in the details needed for delivery and invoicing on the checkout page, tick your agreement to these terms and your confirmation of age, and send the order using the Order with obligation to pay button.

Sending the order constitutes a proposal to conclude a contract. The contract is concluded at the moment I send you an order confirmation by e-mail. The confirmation includes a proforma invoice with payment details and a Pay by Square QR code.

I process orders by hand. If goods were unavailable or I could not fulfil the order, I will contact you and refund any money already paid in full.

5. Prices

The prices shown with the products are final. I am not a VAT payer, so no VAT is added to them. The cost of delivery under Article 7 is added to the price of the goods.

The price applicable to an order is the one shown at the moment the order is sent.

6. Payment

Payment is made by bank transfer in advance. I do not offer other payment methods at present.

After you send the order you will receive the payment details by e-mail — the account number, the amount and a variable symbol. The variable symbol is the order number; that is how I match your payment to your order.

I dispatch goods once payment is credited to the account. If payment does not arrive within 14 days of the order confirmation, I consider the order cancelled.

7. Delivery

I deliver to an address only, not to pick-up points, and within the Slovak Republic only for now. Delivery to other European Union countries is being prepared; until I switch it on, I do not accept orders to be delivered outside Slovakia.

Shipping is €4 per order. For orders over €100 delivery is free. The amount is shown in the cart and on the checkout page before you send the order.

I usually dispatch goods within three working days of the payment being credited.

8. Receiving the goods

Check the parcel on receipt. If the packaging is damaged, make a damage record with the carrier or do not accept the parcel and let me know.

9. Withdrawal within 14 days

If you are a consumer, you have the right to withdraw from the contract within 14 days of receiving the goods, without giving a reason.

Send the withdrawal by e-mail to cbdicaleurope@gmail.com or in writing to the registered office. A clear statement that you are withdrawing is enough; please include the order number and an account number for the refund.

Send the goods back to me no later than 14 days after the withdrawal. You bear the cost of returning the goods. I do not accept cash-on-delivery parcels.

I will refund your money including the delivery cost no later than 14 days after receiving the withdrawal, but only once the goods have reached me or you have proved that you sent them. If you chose a more expensive delivery than the cheapest one offered, I refund the amount corresponding to the cheapest.

When withdrawal is not possible — please read this before ordering.

I supply all products closed with a protective element that is visibly broken on first opening. Depending on the type of packaging this is:

  • for drops and oils — a protective seal on the closure,
  • for capsules and the balm — a label joining the lid to the container; this may also be the product label itself.

These are goods that are not suitable for return for reasons of health protection and hygiene. If you break this protective element after delivery, the right to withdraw from the contract without giving a reason ceases to exist. This follows from § 19(1)(e) of Act No 108/2024 Coll. and Article 16(e) of Directive 2011/83/EU.

If you are not sure whether a product is right for you, do not open the packaging — with the protective element intact you can return it within 14 days without giving a reason.

The right of withdrawal also does not arise for products made to order according to your requirements.

This does not concern complaints. If goods are defective, your rights under Article 10 remain in force regardless of whether the seal was broken — a defect in an oil cannot be detected otherwise.

10. Complaints

I am liable for defects in the goods under the Civil Code. If goods have a defect, you have the right to have it remedied, to a replacement, to a reasonable discount or to withdraw from the contract.

Make a complaint by e-mail to cbdicaleurope@gmail.com. Include the order number, a description of the defect and a photograph if the defect is visible.

I will settle the complaint within 30 days of it being raised and will inform you of the outcome in writing.

The guarantee does not cover defects caused by improper storage or mechanical damage, nor ordinary wear. Store the products dry and out of direct sunlight.

11. Alternative dispute resolution

If you are not satisfied with the handling of a complaint, you may ask me for redress by e-mail. If I reply negatively or do not reply within 30 days, you have the right to submit a proposal for alternative dispute resolution to a body listed by the Ministry of Economy of the Slovak Republic — for example the Slovak Trade Inspection.

A proposal may also be submitted through the European Commission’s online dispute resolution platform.

12. Cooperation and wholesale

If you are interested in wholesale cooperation, distribution or supply for your premises, write to me at cbdicaleurope@gmail.com. Terms, prices and volumes are agreed individually, under a separate contract.

The provisions on consumer withdrawal under Article 9 do not apply to wholesale relationships.

13. Data protection

Who processes the data

The controller is CBDICAL spol. s r. o., with the registered office given in Article 1. The responsible person is Matej Bičan.

What data and why

To fulfil an order I process your name and surname, delivery and billing address, e-mail and telephone number. The legal basis is performance of a contract under Article 6(1)(b) GDPR — without these details I cannot fulfil the order.

I retain invoice data for the period required by the accounting act, that is ten years. The legal basis is compliance with a legal obligation under Article 6(1)(c).

Who I pass it to

I pass the delivery address and telephone number to the carrier that delivers the parcel. Accounting documents are processed by an accountant. I provide the data to no one else and I do not sell it.

Your rights

You have the right of access to your data, and to its correction, erasure, restriction of processing, portability, and the right to object. You can exercise these by e-mail at cbdicaleurope@gmail.com.

If you believe the processing infringes your rights, you may lodge a complaint with the Office for Personal Data Protection of the Slovak Republic.

Cookies and traffic measurement

The site uses no tracking cookies and no profiling. The cart remembers your selection directly in your browser and this data is not sent anywhere. I measure traffic with a tool that uses no cookies and does not identify individual visitors.

14. Governing law and language

The contract is governed by the law of the Slovak Republic. This choice does not affect the protection afforded to a consumer by the mandatory provisions of the law of the state of their habitual residence. If you are a consumer resident in another member state of the European Union, you may bring your claims before the court of your own domicile.

These terms are drawn up in Slovak and in English. Both versions are intended to be identical in substance; where there is doubt as to meaning, the interpretation more favourable to the consumer applies.

15. Final provisions

I may change these terms. For an order already sent, the version in force at the time it was sent always applies.

The Legal framework and maker’s statement also applies to the sale and use of the products and forms an inseparable part of these terms.

Should any provision prove invalid, the remainder stays in force.
